These terms and conditions govern all supply of goods and services ("products") by Primo Vino Ltd (trading as Primo Vino) to you, the purchaser of goods and services from us, including your use of this website at www.primovino.co.nz.
We reserve the right to update or revise these terms and conditions at our discretion. Any changes will take effect immediately once they are posted here on our website.
If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
Although the information provided in this site is presented in good faith and believed to be correct as at the date it was submitted, we make no warranties or representations about the accuracy or completeness of this site, or its contents


Age restrictions

To make a purchase from our online shop you must be 18 years of age or over. You may not purchase from this website to supply anyone who is under the age of 18 years

Primo Vino is committed to upholding its legal and social obligations as a retailer of wine. By placing an order you confirm that you (and the recipient of the wine) are at least 18 years old.


Pricing Availability and Supply

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") but are exclusive of delivery charges. Where an end date is specified on any offer on our site, it is intended as a guide only. We reserve the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before we accept your order.
We make every effort to correctly display our prices and vintages on this website. However if a product that you have ordered has been incorrectly priced we will contact you to give you the option of paying the correct price or cancelling your order. All orders are subject to the availability of those products. If for any reason a product is not available, we will notify you as soon as possible. We reserve the right to limit any sale.


Delivery and delivery charges

Prices for products on our website are exclusive of any applicable delivery charges.
The cost of delivery is as stated on our website and a total delivery cost will be provided on the order summary of your online shopping basket. Please note that the delivery areas are defined by our courier company. An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct. We will advise you if you have chosen the incorrect delivery region.
We aim to dispatch your order within 24 hours of it being received Monday to Friday. Orders over the weekend will be packaged and dispatched Monday. If there is any delay to your order we will notify you by email. Deliveries are by PBT Couriers and are available to addresses throughout New Zealand. We do not deliver to PO Boxes. Some orders in Hamilton city we deliver ourselves. Expected delivery times are 1-3 working days depending on the destination. Rural delivery takes 2-3 days extra. If your order has not been delivered within this period please contact us.
If any of the order is missing or damaged please keep hold of the delivered product, the delivery note and any packaging. Please check your order when it is received and notify us within 48 hours of any problems.


Cancellation Refund & Returns

If you need to cancel some or part of your order you must contact us immediately on 07 8393139 or email wine@primovino.co.nz. We will do our best to accommodate your needs. We can only cancel or alter your order if it has not been processed by us.

Unless otherwise agreed, refunds will be made by the original payment method.

Your palate is your own. We do our best to match our range with your tastes and get it right most of the time, but there are occasions when this doesn't happen, so… All wine is guaranteed; simply return any unopened, undamaged bottles (no heat, sunlight, label or capsule damage) for a full refund or exchange within 30 days of purchase.
If you receive corked or faulty wine we will replace or refund it. We require the faulty bottle and the contents to be returned to us so we can liaise with our suppliers as to the nature of the fault.

The website credit card payment system is through Windcave (formerly known as Direct Payment Solutions or Payment Express) a PCI compliant payment gateway for merchants worldwide accepting credit & debit cards. Windcave is a long-established gateway used and trusted by thousands of businesses worldwide. It's a reliable way to pay online using a credit card.
Windcave have a dedicated and purpose built development and data centre, specially designed for payments processing. They have invested and continue to re-invest in state of the art, bank grade security and infrastructure, and are fully certified as Visa AIS and MasterCard SDP (PCI DSS) compliant at processor level; using an approved QSA for quarterly scans on systems and full onsite audits, annually. All sensitive information is encrypted with the 3DES protocol, using financial Hardware Security Modules.

Primo Vino does not have access to your full card number; this credit card payment is secured by Windcave. Payments are processed in real-time.

We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control .
Whilst every endeavour is made by Primo Vino to ensure best practice, we do not warrant that this site, its servers, or e-mail sent from Primo Vino are free of viruses or other harmful components or that information transmitted to us is secure at all times. Primo Vino will not be liable for any damages of any kind arising from the use of this site or linked sites, including, but not limited to – direct, indirect, incidental, punitive, and consequential damages. You must take your own steps to ensure that the process which you employ for accessing this site does not expose you to the risk of viruses or other forms of interference which may damage your computer system.


Liability Limitation
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website. We will not be liable for any damage, loss, claim or expense suffered as a result of the information on this site or any linked site not being accurate or updated.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises. If a product offered by Primo Vino is not as described, your sole remedy is to return the product in unused condition for a refund of the amount you paid.
Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.


Applicable Law and Jurisdiction


Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.
Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.


Privacy Policy and Confidentiality


Security of personal information is important to us and we take all reasonable precautions to protect personal information from misuse, loss, unauthorised access, modification or disclosure.

We do not pass your details onto anyone else unless required to by law.
Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.
Opting out of receiving messages will not prevent the sending of messages that specifically relate to your order(s).
We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.

When you use the website our server logs the following information, which is provided by your browser:

your server's IP address (a number which is unique to the machine through which you are connected to the Internet) or your personal IP address
